The following is the Acceptable Use Policy all customers must abide by when using their A-V Tronics service. It outlines the various acceptable uses for your account and what we consider abuse. By signing up and/or using your A-V Tronics account, you agree to abide by this policy and our Terms Of Service policy and to keep updated on any changes which may occur. This policy may change at any time without notice.
Account Services
By signing up for an account with A-V Tronics you are assuming responsibility for all actions of users that you permit onto the system. Failure to comply with this regulation is in direct conflict with the Terms & Conditions which every customer should have read and has agreed to by using our service.
Net Etiquette
At A-V Tronics, we would like every customer to have the best Internet experience possible; however, we do not wish it to be at other customers' expense. The Internet is a global computer network which is comprised of people from diverse backgrounds. When communicating with people on the Internet, it is best to keep in mind that there is another person on the other end of the computer that you are communicating with. Please treat others with the same respect as you would like to be treated.
Free Speech
A-V Tronics promotes free speech and believes all users are entitled to their opinion. Users must ensure that their opinion and use of free speech do not breach Netiquette. Threats of any kind are not tolerated. We apply fair use rules when quoting copywritten works.
Copyrights
Almost every country has copyright laws and there are international copyright laws. A-V Tronics cannot and does not review the information flowing through or stored on our system. When you become a A-V Tronics customer, you are agreeing not to transfer or store copyrighted works on our system without the written permission of the copyright holder.
Content
The content of your website is not regulated or monitored by A-V Tronics other than your bandwidth useage; therefore, A-V Tronics is not liable for contents. We will react to all complaints from legitimate sources.
Chain Letters/Pyramid Schemes
According to United States and Canadian law, chain letters and pyramid schemes are illegal. If you are found to be hosting or sending these then your account will be termininated without question. Chain letters and pyramid schemes fall under the category of abuse and spam and penalties are similar.
System Security
You will not attempt to bypass any security features of the system or this website or attempt to access features of the system or this website that you do not have normal access to and have not been given permission to access.
In the event of a security breach due to an insecure script on your site your account will be terminated without notice or refund
Spam and Abuse
Spam and abuse is defined by A-V Tronics as;
- the repeated posting of articles to inappropriate newsgroups
- posting messages or email for the purpose of unsolicited advertising/promotion whether for commercial or personal purposes
- offtopic messages on newsgroups or message boards for the purpose of directing users to your website
- repetitive posting
- violating any other items on this page or on the TOS
A-V Tronics does not tolerate spam or abuse in any form. All complaints will be investigated thoroughly. If you are unsure if what you want to do will be considered spam feel free to contact support and ask.
IRC
We do not permit any IRC related processes which may include BNC's, shell accounts, bots or DNS hosting.
Penalties
Any account closed due to spam or abuse compaints will be charged a fee of $50.00 US for each complaint for clean up fees and an additional $50.00 US fee for each spam email or message sent.
Email Lists
A-V Tronics offers hosting of opt-in mailing lists. These lists must be built by your customers joining manually and not purchased lists. Purchased lists are usually not legitimate customers and such lists were probably generated by collecting email addresses without consent. Using purchased email lists is considered abuse and usually generates large amounts of complaints. You may import lists that your customers have previously opted into on another host.
Privacy
We do not monitor what is downloaded or viewed from our system, we only monitor bandwidth use. Your name and all personal information will be kept private. The only way we will reveal your information is with a court order. Please see our Privacy Statement for more information.
Legal Proceedings
You agree that any and all legal proceedings that may arise between yourself or anyone who uses your account and A-V Tronics, it's officers, employees, partners, agents, and shareholders will be held within the jurisdiction of the offices of A-V Tronics, specifically located within the City of Winnipeg, Manitoba, Canada. |
